Legal Terms and Conditions of Sale
Warning: Most of these products require an Exports license. It is the buyer’s sole responsibility to apply for an export license with the US government if they are intending to export.
Level III Rifle Plates, Level III-A and Level II vests, and Ballistic Helmets (without Rails or Night Vision attachments) are controlled by the Bureau of Industry & Security (BIS). These items can often be exported with the appropriate export license exemption, but only when going to approved countries. Some countries, or larger quantities, may require an export license. It is the buyer’s responsibility to investigate and navigate these export laws, restrictions and regulations.
Level IV Rifle Plates and Ballistic Helmets fall under the jurisdiction of the International Traffic in Arms Regulations (ITAR), and are subject to the export control laws of the U.S. Government. Export or retransfer of Rifle Plates or Helmets with Accessories by any means to any foreign end user, or for any other end use, whether in the U.S. or abroad, without the written approval of the U.S. Department of State, is prohibited.
There is often an exemption for Rifle Plates for a U.S. person taking their personal protection with them in their luggage, and returning the armor to the US. It is the buyer’s responsibility to investigate and navigate these laws, restrictions and regulations.
Penalties for transgressions of export regulations can be severe, so be sure to exercise careful due diligence.
We are careful to comply with U.S. export regulations. You, the customer are responsible for complying with your country’s import regulations, and paying all import duties and taxes and fees. Please be sure to check regulations and taxes in your jurisdiction before ordering.
It is the sole responsibility of the purchaser to ensure that all transactions conform to U.S. and Federal, State and Local Statutes, Codes, and Ordinances and the purchasor’s local laws and regulations.
We do not sell to felons or minors. By buying a vest from us, you certify that you are of adult age, have no felony convictions and are a law-abiding citizen.
It is against the law for a person convicted of a ‘crime of violence’ to possess Body Armor under federal law (unless required by your employer, see, Sec. 931). It is also illegal under state law for a convicted felon to own armor in many states.
We reserve the right to refuse to sell to anyone, in our sole discretion. By buying body armor you guarantee that you are not legally prohibited from owning firearms, or body armor, and also that you are not associated with any criminal group, in any way, and have only a lawful purpose for owning body armor.
NO Armor is 100% Bulletproof. A ‘bulletproof’ vest or other armor will protect you from the vast majority of pistol ballistic threats you are ever likely to face. But there is always a tradeoff between more protection and more wear ability (and the constraint to stay within your budget). Please know that: rifle rounds, unusual high velocity pistol ammunition, pistol ammo fired from a rifle barrel, armor piercing ammunition, sharp-edged or pointed instruments (e.g., knives, icepicks, etc.), and/or other unusual ammunition or situations can defeat body armor.
Also, at some angles projectiles can slide, or deflect off the edges of Armor, or ricochet. Furthermore, projectiles that are successfully stopped by armor will always produce some level of injury, resulting in severe bruising, broken bones, and possibly serious internal injury or even death. Soft body armor defeats most pistol and shotgun projectiles, but NO vest on earth makes you invulnerable to all threats. To state the obvious, getting shot ALWAYS carries some risk.
Be aware that your head is much more susceptible to blunt trauma than your body. Any impact of a bullet on a helmet will cause injury and can cause death. You put the odds more in your favor with head protection, but, just as with any armor, no guarantee of invulnerability can be made.
By buying Armor you assume ALL risks of use or misuse, and agree not to hold us liable in any way. In addition, YOU are responsible to ensure that your ballistic panels are positioned inner side IN, and outer side OUT if applicable (check the inside vest panel label).
We Assume No Liability. We neither assume, nor authorize any person to assume for us any liability in connection with the sale or use of the goods sold, and there are no oral agreements or warranties collateral to or affecting this agreement. We hereby give notice that any statement made by us in the sale of the goods, shall not create any warranty that the goods shall be fit for any particular purpose. Statements, images or descriptions are informational only, and not made or given as a warranty of the goods in any way. We specifically disavow any other representation, warranty, or liability related to the condition or use of the goods.
We do not cover any consequential damages, and our liability is limited to repairing or replacing defective goods. Pursuant to the provisions of the California Song-Beverly Consumer Warranty Act, this product is sold “AS IS” and “WITH ALL FAULTS”. The entire risk as to the quality and performance of the product is with the buyer. We are not an insurer, and bear no liability for any use, misuse, or failure to perform.
Purchaser covenants and agrees that the purchaser or his heirs, agents, assigns shall NEVER bring any action in any court of law. Any dispute arising from the Purchase and Sale of product(s) sold by DBA TopBodyArmor.com or Bullet Proof Armor LLC , shall be resolved by Arbitration under the Rules of the American Arbitration Association. Venue for any arbitration, or any legal dispute, shall lie only in City of Greenville, Hunt County, Texas and in no other Venue or Forum. The Laws of the State of Texas shall apply to all transactions.
If any part of these Terms are held to be invalid by a court of competent jurisdiction, such shall not affect the validity of any other part of these Terms. Headings are for convenience only, and do not limit or affect these Terms.
